Matthias, the old English rules had some issues - some formatting, and some others. That is why they are being reworked right now. Unfortunately, I am basically knocked out cold by a very serious case of the flu. Writing a few coherent sentences is no problem, working on the English rulebook is another matter...;)
That is why I asked if you did not get the German rulebook in Essen.
You find that one here at BGG for download, and it should help with most issues, as I tried to make the rules as clear as possible...

Yes, you are correct, the maximum stacking limit for one player is 5, in the third and fourth round of the game. And, of course, 5+2 don't make 8. However, the first line of the paragraph(s) you are quoting relates not to when battles take place, but when they end. And the second part concerns the situation of a battle that ends with enough units in place that another one would start immediately after the next player turn.
